User Registration, Your Account and Password

In order to access certain functionality of the PC Website or third party services / technologies, which may be used in fulfilling our contractual obligations, users may be required to register an account. PC reserves the right to modify, expand or retire any PC Website functionality. By registering to the PC Website or third party services, you agree to provide accurate, current and complete information about yourself and maintain and update your personal information. No Unlawful or Prohibited Use

As a condition of your use of the PC Website, you warrant to PC that you will not use the PC Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the PC Website in any manner which could damage, disable, overburden, or impair the PC Website or interfere with any other party’s use and enjoyment of the PC Website.

Materials Provided to PC or Posted on PC Website

PC does not claim ownership of the materials you provide to the PC Website including blog posts, uploads, images, photos, company and/or product related information, comments, feedback, suggestions or input to the PC Website or its associated services (collectively “Contributions”). However, by posting, uploading, inputting, providing or submitting any Contribution you are granting PC, its affiliated companies and necessary sub-licensees permission to use the Contribution in connection with the operation of their businesses including, without limitation, the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat the Contribution; and to publish your name in connection with the Contribution.

No compensation will be paid with respect to the use of your Contribution, as provided herein. PC is under no obligation to post or use any Contribution you may provide and may remove any Contribution at any time at PC’s sole discretion.

By posting, uploading, inputting or providing your Contribution you warrant and represent that you own or otherwise control all of the rights to your Contribution as described in this section including, without limitation, all the rights or permissions necessary for you to provide, post, upload, input or submit the Contributions. You agree that you will be liable to us and indemnify us for any breach of this warranty.

You agree that PC has the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the PC Website constitutes a violation of their intellectual property rights, or of their right to privacy.

PC reserves the right to edit, delete or refuse to post any Contribution for any reason without notice. Furthermore, PC is under no obligation to delete any Contribution that you may personally find offensive or questionable and holds no responsibility over the accuracy, timeliness and completeness of any Contribution on the PC Website.

PC cannot and will not be liable for any losses, damages or costs arising from your failure to comply with these requirements.

Use of Software

Copyright in any software or service that is made available for download or use via the PC Website belongs to PC or its suppliers. Your use of the software is governed by the terms of any licence agreement that may accompany or be included with it. Do not install or use any software unless you agree to such licence agreement.

Liability Disclaimer

The information, products, services and software included in or available through the PC Website may include inaccuracies or typographical errors. Changes are periodically applied to the information herein. PC, its suppliers and/or users of the PC Website may make improvements and/or changes in the PC Website at any time. Advice received via the PC Website should not be relied upon for personal, medical, legal or financial decisions and you should consult a professional for specific advice tailored to your situation.

PC, its suppliers and/or users of the PC Website make no representations about the completeness, suitability, reliability, availability, timeliness, and accuracy of the information, visuals, products, services and software contained on the PC Website for any purpose.

PC, its suppliers and/or users of the PC Website hereby disclaim all warranties and conditions, whether express or implied, with regard to this information, visuals, products, services and software; including all implied warranties or conditions of fitness for a particular purpose, title and non-infringement.

To the maximum extent permitted by applicable law, in no event shall PC be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the PC Website, with the delay or inability to use the PC Website or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the PC Website, or otherwise arising out of the use of it, whether based on contract, tort, negligence, strict liability or otherwise, even if PC or any of its users of the PC Website has been advised of the possibility of damages.

PC will not be liable for any contribution, which a user uploads to the PC Website.

PC will not be liable for any loss or damage caused by a virus, malware, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the PC Website or to your downloading of any content on it, or on any Linked Website.

You are responsible for configuring your information technology, computer programmes and platform in order to access the PC Website. You should use your own virus protection software.

You must not misuse the PC Website by knowingly introducing viruses, malware, trojans, worms, logic bombs or other material, which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the PC Website, the server on which the PC Website is stored, or any server, computer or database connected to the PC Website. You must not attack the PC Website via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the PC Website will cease immediately.

If you are dissatisfied with any portion of the PC Website, or with any of these terms of use, your sole and exclusive remedy is to discontinue using the PC Website.

Termination/Access Restriction

PC reserves the right, in its sole discretion, to terminate your access to the PC Website and the related first and third party services or any portion thereof at any time, without notice.

General

This Agreement is governed by English law and The English courts will have jurisdiction over any claim arising from, or related to, a visit to the PC Website. You hereby agree to the exclusive jurisdiction and venue of courts in England & Wales in all disputes arising out of or relating to the use of the PC Website.

PC’s performance of this Agreement is subject to existing laws and legal process, and nothing contained in this Agreement is in derogation of ITE’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the PC Website and/or information provided to or gathered by PC with respect to such use. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue to remain in effect. Unless otherwise specified herein, this Agreement constitutes the entire Agreement between the user and PC with respect to the PC Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and PC with respect to the PC Website.

A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this Agreement and all related documents be drawn up in English.

Copyright and Trademark Notices

Copyright law protects all materials available on the PC Website by PC.

No part of the materials available on the PC Website may be copied, re-used, reproduced, translated or reduced to any physical/electronic medium or machine-readable form, in whole or in part, without the prior written consent of PC. Any other reproduction in any form without the permission of PC is prohibited. Distribution for commercial purposes is also prohibited.
